Purpose of Processing Personal Data and Legal Basis

Personal data will be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: “GDPR”), for the following purposes:1) responding to inquiries, including requests for quotations (Article 6(1)(b) GDPR) – for the time necessary to handle the matter, including sending marketing information about selected products or services, no longer than 6 months after the matter has been handled for archival purposes or until the expiry of limitation periods provided for by applicable law,
2) providing services or taking steps at the request of the data subject prior to entering into a contract (Article 6(1)(b) GDPR) – until the service is completed,
3) defending against claims (Article 6(1)(f) GDPR) – for the limitation period specified in applicable law,
4) fulfilling legal obligations of ACNS PROJECTS BRYL&BRZOZOWSKI SPÓŁKA JAWNA, e.g. issuing and storing invoices and other accounting documents, preparing tax information, documenting and settling public law liabilities (Article 6(1)(c) GDPR) – for the period specified by applicable law,
5) direct marketing of products or services of ACNS PROJECTS BRYL&BRZOZOWSKI SPÓŁKA JAWNA – based on the legitimate interest of ACNS PROJECTS BRYL&BRZOZOWSKI SPÓŁKA JAWNA (Article 6(1)(f) GDPR in connection with Recital 47 GDPR) – until objection is raised,
6) creating reports, statistics, and/or analyses for the internal needs of ACNS PROJECTS BRYL&BRZOZOWSKI SPÓŁKA JAWNA (Article 6(1)(f) GDPR) – until the objection raised by the data subject is taken into account,
7) sending marketing content electronically by the Controller and/or entities within the group of companies to which the Controller belongs (Article 6(1)(a) GDPR in connection with Article 172 of the Telecommunications Law of 16 July 2004 and Article 10 of the Act on the Provision of Electronic Services of 18 July 2002) – if a separate consent is given, until it is withdrawn. Withdrawal of consent may take place at any time but does not affect processing carried out before the withdrawal.
2. Personal data is provided on a voluntary basis. Refusal to provide personal data may result in the inability to provide a given service.
III. Recipients of Personal Data
1. Data recipients may include entities within the group of companies, within the meaning of the GDPR, to which the Controller belongs, as well as entities or individuals cooperating with the Controller for the purposes specified in Section II above.2. In the case of transferring data outside the European Economic Area (EEA), using tools of entities based outside the EEA, or entities that may store data outside the EEA (your personal data will not be transferred to international organizations), the Controller will apply all legally available safeguards (e.g. those provided in Article 46 GDPR) to secure such transfers. Transfers outside the EEA may also take place based on exceptions provided in Article 49 GDPR, provided the conditions specified therein are met. IV. Your Rights
1. You have the right to access your data and to request its rectification, erasure, restriction of processing, and data portability (where applicable).2.
